Our Promise to You! Purchase a Premium Highlander Programme and we'll identify at least 2% of your annual sales in increased sales, business efficiencies & profit opportunities! If not, you will only pay 50% of the fee! Highlander provides real value and helps our clients increase their efficiencies and boost their profits, but we recognize that many potential clients will still be reluctant to make a commitment or quite simply will not believe our claim! So, to re-assure our clients, here is our "Put Up or Shut Up" guarantee! (and as far as we know, we are the ONLY business offering this type of guarantee for our type of services!) 2. Client agrees: a. To act as a reference for Caledonian b. All reimbursement details may be used by Caledonian for any purpose, in any manner whatsoever.
3. Client must have employed at least 10 Full Time employees (excluding owners and family members) (for a total minimum of 20,800 hours) for all of the prior year.- 4. Client must currently employ at least 10 Full Time employees (excluding owners and family members) at their primary site or business location (excludes work at home or external sales staff who do not work in an office at the main site).
- 5. Client must have had at least $2.5 Million in annual sales for the prior year and must still be engaged in the same line-of-business as the prior year.
- 6. Caledonian will identify at least 2% in Dollar value of the prior year's annual sales or the projected current year's annual sales (whichever is lower) in the form of cost efficiencies, increased sales, cost savings, operational savings, system improvements, management improvements and other measures.
7. Client shall make fully available ALL necessary and requested data, reports, financial information, operational information and any other such information and data as may be requested or required by Caledonian in the course of the assessment.
8. If Caledonian CANNOT find the 2% promised, then the Highlander Programme shall be completed and delivered to the Client as per the Agreement. The total due shall be 50% of the originally agreed fee and the client shall not be liable for payment of the remaining 50% of the fee. Such adjustment of fee shall apply only to the original programme price and not to any additional services purchased by the client, such as Caledonian Direct services, consulting time, etc.
9. There shall be NO extra charges and NO other expenses billed to the client as a result of the failure of Caledonian to find the 2% minimum.- 10. If the client fails to adhere to any of these provisions, provides incomplete or false data, does not make staff or information available to Caledonian in a timely manner, submits a form of payment that is refused or not honored by the bank (e.g. a check is returned for Non-Sufficient Funds "NSF"), then this guarantee shall be null and void, the client shall not be entitled to any refund of any fees, shall not be entitled to receive any report or assessment, nor participate in the Highlander Programme offered by Caledonian.
- 11. In the event that a client does not pay the full price for the Programme when due, does not pay for any additional services purchased as per any agreement with Caledonian, or only makes a partial payment, then all monies previously paid shall be forfeit and not subject to any refund. Additionally, Caledonian shall NOT be obligated to perform the Highlander Assessment or allow the client to participate in the Highlander Programme unless full payment is made prior to the commencement of any work.
12. Client understands and accepts that this is NOT a guarantee of actual savings that can be expected, nor a guarantee of any improvement in business operations that may be expected as a result of the Highlander Programme. Rather, the Highlander Programme identifies saving opportunities, increased sales opportunities , management & operational efficiencies that the client can implement which will increase their efficiency, increase sales revenue, improve profit or reduce costs if they are implemented properly and in a timely manner by the client. The outcome of such actions are NOT guaranteed by Caledonian. The guarantee provides for the IDENTIFICATION of such savings, opportunities and management changes, not the actual outcome of any such recommendations.
13. Client acknowledges and accepts all these conditions without reservation or change, upon the Purchase of the Highlander Programme.
14. The following are NOT ELIGIBLE for the Guarantee, but all other Terms and Conditions of the Programme shall apply: Medical or Dental offices | Companies <10 Employees | Commodity Traders | Hospitals or Medical clinics | Banks and Financial Institutions | Auto Dealers | Companies < $2.5 Million in sales pa | Franchisee's of major brands | Real Estate Businesses | Businesses that derive the majority of their income from third party payers (e.g. Medicare, insurance companies, etc.) |
